1. Introduction

Welcome to My Website Doctor. These Terms of Service (“Terms”) govern your use of our services. By engaging our services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Services Provided

My Website Doctor offers the following services:

• One-off Task: Any task that can take up to 2 hours to complete.
• Maintenance Plan: Complete website maintenance, including one-off tasks at a discounted rate.
• Unlimited Plan: Complete website maintenance, unlimited task requests, and content management (adding and removing content).
• Premium Plan: All features of the Maintenance and Unlimited Plans, plus SEO and speed optimisation tasks.

3. Engagement Process

• Information Submission: Clients must submit basic information via a form.
• Payment: Services are provided after payment is made or subscription is set up. Payments are processed through Stripe via email links.
• Dashboard Access: Upon payment, clients receive access to their personal dashboard created using Trello.

4. Payment Terms

• Fees: Fees for services must be paid in full prior to commencement unless subscribed to a monthly plan.
• Monthly Subscription Plans: For Maintenance, Unlimited, and Premium plans, payments are recurring monthly.
• Late Payments: Late payments may incur additional charges, and services may be suspended until payment is received.

5. Cancellation Policy

• Notice Period: A 30-day notice period is required for the cancellation of any subscription plan.

6. Client Responsibilities

• Information: Clients must provide accurate and complete information necessary for the provision of services.
• Access: Clients must grant My Website Doctor necessary access to websites and relevant systems.
• Compliance: Clients must ensure that their use of our services complies with all applicable laws and regulations.

7. Service Delivery

• Task Completion: Tasks are typically completed between 2 and 24 hours, depending on workload.
• Service Commencement: Services begin after payment is confirmed.
• Modifications: Any changes to the scope of services must be agreed upon in writing. Additional fees may apply for modifications.

8. Security Measures

We employ strict security measures to ensure the confidentiality and safety of customer and website data, including login details, emails, and passwords.

9. Satisfaction Guarantee

• Refund Policy: If a customer is not satisfied with our resolution to their problem and provides a solid reason for their dissatisfaction, we will refund any money paid to us.
• Task Incompletion: If we are unable to complete a task for any reason, we will refund any money paid for that task.

10. Confidentiality

My Website Doctor will maintain the confidentiality of all sensitive information provided by the Client. This obligation extends beyond the termination of the Agreement.

11. Intellectual Property

• Ownership: Clients retain ownership of all materials provided to My Website Doctor. My Website Doctor retains ownership of any methodologies, tools, or frameworks used in the delivery of services.
• License: Clients grant My Website Doctor a non-exclusive license to use, reproduce, and modify materials solely for the purpose of providing the services.

12. Limitation of Liability

• Exclusion: My Website Doctor will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services.
• Limit: My Website Doctor’s total liability under this Agreement shall not exceed the fees paid by the Client for the specific service in question.

13. Indemnification

Clients agree to indemnify and hold harmless My Website Doctor from any claims, damages, liabilities, and expenses arising from the Client’s use of the services or breach of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

My Website Doctor reserves the right to modify these Terms at any time. Any changes will be posted on our website and will become effective upon posting. Clients are advised to review these Terms periodically.
